Description

The "Religious Educational and Charitable Institutions Act of 1861" was assented to on August 13, 1861. The Act enabled the Executive Council to issue Letters Patent to religious, educational and charitable groups. Organizations registered under this Act were able to manage estates, properties and effects; receive and purchase property; borrow and lend money; sue and be sued; invest money; purchase and trade shares; inherit money or goods from an estate provided that the deed of grant was made at least one month prior to the person's death in the presence of three credible witnesses.

The provisions of the Act were later expanded through a series of amendments and in 1959 Agricultural Shows were also able to register under this Act.

Organizations registered had to file proof of succession with the Supreme Court Registrar and the files can include documents such as correspondence, affidavits as to the identity of those elected to management positions and an organization's constitution.

This Act was repealed and replaced by the "Associations Incorporation Act 1981" which became responsible for registering all new incorporations. Letters patent issued under the previous act retained their legal standing.
