Information Sources

These valuation files record details of appeals to the Land Court or Land Appeal Court against land valuation decisions. The majority of appeals arose from annual land valuations made by the Valuer-General.

The files were created by the Land Court to record details following an Appeal to the Court Against a Land Valuation Objection Decision. Many appeals arose from Quinquennial Land Valuations made by the Valuer-General and from 1993, by the Chief Executive, Department of Lands. From July 1985, an annual valuation system progressively replaced the five year system. The valuations were used by local authorities to determine the rateable value of properties. The land owner objecting to a land valuation had the right to appeal to the Land Court. The Land Court was based in Brisbane, where the registry was located, but it also held sittings in the principal country towns and in smaller centres where courtroom accommodation was available. The court was constituted by a single member sitting alone. If a satisfactory conclusion was not reached at this level, the appellant had the right of appeal to the Land Appeal Court, constituted by a Judge of the Supreme Court and any two members of the Land Court exclusive of the member who pronounced the decision appealed against. A party aggrieved by a decision of the Land Appeal Court could appeal to the Full Court (now Court of Appeal) against the decision.

Documents in the files may include: correspondence, decisions, transcripts, exhibits, notices of appeal. Maps and photographs are found in some files.

Missing file numbers mean that files dealing with withdrawn appeals have been culled from this series. This series does however include matters which came before the Court, had a decision recorded against them and were consequently 'struck out'.
