This series consists of appeals for civil cases heard in the District Court, Stanthorpe and the Planning and Environment Court (P and E Court) which is an area of responsibility of the District Court.
In appeal hearings, the reasons for the appeal and any supporting documentation is presented by the appellant (the person or organisation) that commenced the appeal. The respondent is the opposing person or organisation to the appeal. Both may be represented by a solicitor/barrister. In this series, the civil case file deals with appeals against monies owed.
The Planning and Environment Court hears matters relating to planning and development, protection for the environment, nature conservation, vegetation management, fisheries, and heritage. The court may hear disputes and appeals relating to town planning, land subdivision and rezoning, decisions against development applications, decisions on compensation claims, and appeals about infrastructure charges. The cases in this series deal with decisions made by the Stanthorpe Shire Council relating to the change of land use, conditions imposed, approved applications and refused applications. A notebook includes the following details: appeal number, appellant, respondent, nature of appeal, fees and result.
Documents include notices of appeal; notices of election, notices of discontinuance/withdrawal, entries of appearance; judgments; affidavits; court transcripts, exhibits and general correspondence.
