Description

The Immigration Act of 1869 repealed the 1864 Act and its provisions with regard to land orders. Land orders could be issued by the Agent General for Emigration to persons proceeding by ship sailing directly to Queensland from Europe, who had paid the full cost of passage for himself, his family which included domestic servants. Steerage and intermediate passengers had to sail on approved ships which meant that they sailed under the authorised instructions to Surgeon Superintendents of Queensland ships.

Non transferable land orders were available immediately on arrival and enabled the recipient to select 40 acres for each person 12 years and older and 20 acres for each child between the ages of one and 12. Land was to be in areas designated as country land, it had to be proclaimed open for selection, and the land was to be for his own use and benefit. The Land Agent issued a licence to enable the selector to enter the land and occupy it for five years.

The selector could receive a Crown grant of the land after 5 years, or before if he had resided continuously on the land for three years, had not alienated any of the land, and had cultivated one tenth or fenced the whole of the land with a substantial fence.

Selectors could not sell their licences, however a licence or unused land order could be bequeathed under the terms of a will, or transferred to a widow as part of an intestate estate. If any widow or widower died during the term of the licence, the land could be sold for the benefit of infant children.

Immigrants receiving free or assisted passages or persons obtaining a nominated passage for a friend or relative, could receive land orders on payment of a specified sum.

Some applications for these selections were recorded as for the land selected under the Crown Lands Alienation Acts. However they were numbered differently. Some Land Agents include both numbers on the application and on the Deed of Grant. Some Land Agents did not differentiate. In many instances the immigration selections were not recorded in the registers of selections. Some immigration selections can be located in PRV9882 and some selections issued under the Crown Lands Alienation Acts can be found in this series.
