Description
ESTABLISHMENT:
Following separation from New South Wales, the Registrar - General's Office was established 6 January 1860 to register and regulate the registration of the following: wills, births, deaths and marriages; Acts of Parliament; deeds, conveyances and other legal instruments affecting real property; Charters of Incorporation; and memorials of public companies. The Registrar-General was required to preserve the records relating to registration; and compile and publish the annual statistics for the colony of Queensland.

The Department of Justice's Annual Report for 1995-96 includes, for the first time, the title "Registry of Births, Deaths and Marriages", instead of "Registrar General's Office". Since then the official title of the "Registrar General's Office" has become the "Registry of Births, Deaths and Marriages".

FUNCTIONS:
Since 1860 the chief responsiblity of the office has been the registration of births, deaths and marriages, originally under the New South Wales "Registration of Births, Deaths and Marriages Act of 1855", and continuing under subsequent legislation.

ADMINISTRATIVE STRUCTURE:
Queensland was divided into registry districts. Each district had a Registry Office that was staffed by a District Registrar who was responsible for the registration of records in his particular District. The Assistant District Registrar only had the power to receive registration applications and certificates and transmit them to the District Registrar for registration. The Central Registry was located in Brisbane and held a complete record of all registrations in Queensland. All metropolitan registrations were administered by the Central Registry.

Under the "Real Property Act, 1861" and the "Real Property Act Amendment Act, 1877", the Registrar- General was required to register and regulate the laws relating to the transfer and encumbrance of freehold property and other interests in land. Consequently, the Real Property Transfer Office and Registration of Deeds Office was created. Following the passing of the "Registrar of Titles Act, 1884", the duties and authorities relating to real property were separated from the Registrar - General's jurisdiction and transferred to the Registrar of Titles Office.

The Statistical Branch recorded, compiled and published annual statistics, including the census, on subjects such as population, agriculture, immigration and stock for the colony of Queensland. Under the provisions of the Stock Returns Act of 1893, stock returns were sent by the Clerks of Petty Sessions to the Registrar - General. The Registrar- General recorded the details of all returns in a book. The book was compiled in alphabetical order by the names of the stock owners and according to the Petty Sessions District in which the stock were kept or pastured.

From 13 October 1884 the Registrar-General also held the office of Registrar of Patents, Designs and Trademarks. The Patents, Designs and Trademarks Act of 1884 provided for the transfer of duties, authorities and custody of records from the Registrar of the Supreme Court to the Registrar-General. However, the records were not transferred immediately and on 1 May 1885 the Registrar of the Supreme Court was ordered to transfer all the relevant records to the Registrar - General. The transfer was completed on 4 May 1885.

In the period 3 November 1885 - 6 August 1890 the Registrar- General also held the office of Registrar of Friendly Societies within the meaning of the "Friendly Societies Act Amendment Act of 1885" (49 Vic. No.14). Friendly Societies were required to submit registration forms, documentation and annual returns. As Registrar of Friendly Societies, the Registrar - General also held the office of Registrar of Building Societies and Registrar of Trade Unions.

In the period 9 May 1903 - 1 January 1904 the position of Registrar-General was held in conjunction with the Commissioner of Taxation. From 1 January 1904 the position "Compiler of General Statistics" became the "Government Statistician" and the Commissioner of Taxation was relieved of the duties and responsibilities of Registrar-General. The Deputy Registrar- General was promoted to Registrar-General.

It is not clear when the Registrar - General was relieved of the duties and responsibilities of Government Statistician. However, in the "Statistics Act of 1935" (26 Geo. 5 No. 9) the word Registrar-General was replaced with Government Statistician and the position of Government Statistician was transferred to the Treasurer, Bureau of Industry in the period 1935 - 1936.

From 1 October 1924 the position of Registrar of Friendly Societies, Registrar of Building societies and Manager and Executive Officer, Public Service Superannuation Fund was abolished, and consequently, the Registrar-General was appointed Registrar of Friendly Societies and Registrar of Building Societies. By 1946 the Registrar-General was relieved of the duties of Registrar of Friendly Societies and Registrar of Building Societies.
