The Environment Department was established on 26 February 1996 with the re-naming of the Department of Environment and Heritage by Order in Council.

The Environment Department was created to:
- Reduce waste and air, water and noise pollution
- Maintain biological diversity in land, freshwater and marine habitats
- Curtail land contamination and foster site clean-up and safer use of contaminated land
- Restore degraded land, river and coastal ecosystems
- Recognise the traditional rights of Aboriginal and Torres Strait Island people
- Conserve places of cultural heritage significance
- Foster ecologically sustainable management of natural resources
- Maintain sustainable use of wildlife systems

The Department situated Regional Directors in southwestern, southeastern, central, northern and far northern areas. These Regional Directors were in charge of managers who represented the different aspects that made up the operation of the Department, namely National Parks, Coastal Management, Environment, and Corporate Services.

On 29 June 1998 the Environment Department was renamed the Environment and Heritage Department.
