Description
The first recommendation of the Commission of Inquiry into Possible Illegal Activities and Associated Police Misconduct [Fitzgerald Report], which was released on 3 July 1989, dealt with the establishment of the Electoral and Administrative Review Commission. Following this recommendation, the "Electoral and Administrative Review Act 1989" setting up the Commission was assented to on 25 October 1989. The first Chairman of EARC, Mr Tom Sherman, was appointed on 21 December 1989 and the remaining part-time commissioners were appointed in March 1990. The Commission was fully constituted on 21 March 1990. The founding Chair, Mr Tom Sherman, resigned on 25 February 1992 and was replaced by Mr David Solomon who was appointed on 15 June 1992. Professor Colin Hughes was appointed Acting Chair in the interval. The Parliamentary Committee for Electoral and Administrative Review in its "Report on Review of the Electoral and Administrative Review Act" recommended the abolition of EARC when it concluded its review program. The government adoped that recommendation at a Cabinet meeting on 27 January 1993. Accordingly, the Chair and remaining Commissioners resigned their commissions on 30 September 1993. EARC ceased operation having completed its role as recommended in the Fitzgerald Report.

Function:
In accordance with the "Electoral and Administrative Review Act 1989", the function of EARC was to investigate and report from time to time in relation to:
- the whole or part of the Legislative Assembly electoral system;
- the operation of the Parliament;
- the whole or part of the public administration of the state;
- the whole or part of the local authority electoral system; or
- the whole or part of the local authority administration; and
- to monitor implementation of reforms directed by the Governor in Council or authorized by an Act in relation to matters pertinent to the Commission's functions, and to report in relation to such implementation.
