Under the "Children's Courts Act of 1907" (assented 19 November 1907), all Courts of Petty Sessions were constituted as Children's Courts where a person under 17 years was brought before the court. With the transfer of jurisdiction from Courts of Petty Sessions to Magistrates Courts in 1965, Magistrates Courts were then similarly constituted as Children's Courts for hearing cases of persons under 17 years.

Children's Courts were empowered to hear charges against children, examine witnesses, and if necessary convict or admonish, commit for trial elsewhere and order damages or costs.
Children's Courts established at Magistrates Courts deal with simple offences, while serious offences are usually heard in the Childrens Court of Queensland or the Supreme Court.

The introduction of the "Children's Services Act 1965", provided for operation of Children's Courts, formerly constituted under the Children's Courts Act. The Children's Services Act was administered by the Department of Children's Services and subsequent agencies. The "Childrens Court Act 1992" created a two tier system of juvenile justice with the establishment of the Childrens Court of Queensland with jurisdiction similar to a District Court, alongside Children's Courts constituted at any place where a Magistrates Court could be held.
