Description
ESTABLISHMENT:
The 'Aboriginal Protection and Restriction of the Sale of Opium Act 1897' was the first comprehensive Aboriginal legislation passed in Queensland, bringing an era of protection and segregation, whereby Aborigines and Torres Strait Islanders became wards of the state. Under this Act, Parry-Okeden, the Commissioner of Police, was appointed Protector for all districts. In January 1898 Walter E. Roth was appointed Northern Protector of Aboriginals and Archibald Meston Southern Protector. Local policemen or police inspectors were appointed local protectors.

On 30 March 1904, Walter E. Roth, the previous Northern Protector of Aboriginals, was appointed Chief Protector of Aboriginals, following the Regulations of 25 Mar 1904. His administrative responsibilities were wide ranging and the power to control the lives of Aborigines continued to expand within the same 'protection and segregation' policy of the previous Northern and Southern Protectors.

FUNCTIONS:
The Chief Protector of Aboriginals Office, through its community offices, controlled and managed the Aboriginal population, both adults and children, who were deemed to be 'assisted' or 'wards' of the State. This power was exercised in regard to health, education, employment, housing and accommodation, marriages, deaths, child welfare, personal finances, pensions and benefits, training, finance, property, issue of Certificates of Exemption, removals, etc.

ADMINISTRATIVE STRUCTURE:
Queensland was divided into protectorates, comprising 95 by 1932, administered by a local Protector of Aboriginals (usually a police officer), except for Thursday Island, where the indigeneous population was under the control of the Government Resident from 1908 onwards. The local protectors were responsible to the Chief Protector of Aboriginals while the Chief Protector was responsible to the Secretary of Public Lands. In 1905 control reverted to the Home Secretary's Office. When the Home Secretary's Office became Department of Health and Home Affairs, the Office of the Chief Protector occupied the same relative position as it had while under the Home Secretary's Office.

ABOLITION:
The Office of the Chief Protector of Aboriginals was succeeded by the Office of the Director of Native Affairs with the passing of the The Aboriginals Preservation and Protection Act 1939 and The Torres Strait Islanders Preservation and Protection Act of 1939.
