Description
ESTABLISHMENT:
The "Licensing Act 1885" established Licensing Districts and Licensing Authorities. Some districts already existed under the "Licensing Boards Act of 1879" and the "Licensing Boards Act Amendment Act of 1880". Where such districts did not exist, then Police Districts were constituted as licensing districts for the purposes of the Act.

Members of the Licensing Authority (licensing justices) for each district were its Justices of the Peace and the Police Magistrate of the district; if the district comprised a municipality of division, the chairman of the local authority was appointed a licensing justice. Appointments were for one year. Members of Licensing Boards appointed for licensing districts acted as licensing justices until a licensing justice was appointed.

Licences granted under this Act were of four kinds: licensed victuallers' licences, wine-sellers' licences, packet licences and billiard of bagatelle licences.

Related Acts: Distilleries Act of 1849, the Brewers Act of 1850 and the Liquor Adulteration Act of 1855.

ABOLITION
Under the "Liquor Act 1912", all licensing districts formerly constituted under the repealed Licensing Act became licensing districts for the constitution of Licensing Courts. Additionally, provisions for the constitution of Licensing Authorities were repealed, being replaced by Licensing Courts.

The Licensing Act of 1885 commenced on 1 Jan 1886 and is assumed to be the date on which the Licensing Authority at Gympie was established.
