Description
ESTABLISHMENT:
The Island Court, Murray Island was constituted under the Community Services (Torres Strait) Act 1984. Matters were heard by two justices of the peace who were island residents.

FUNCTIONS:
The Community Services (Torres Strait) Act 1984 outlined the constitution and powers of the court.

Jurisdiction to hear and determine:
Matters of complaint that are breaches of the by-laws applicable within its area
Disputes concerning matters within its area that are not breaches of the by-laws applicable within its area or of any law of the Commonwealth or the State
Matters committed to its jurisdiction by regulations
Disputes concerning any matter accepted by the community resident in its area as a matter rightly governed by the usages and customs of that community

ABOLITION:
Under the Local Government and Other Legislation (Indigenous Regional Councils) Amendment Act 2007, the Island Court, Murray Island was abolished with the repeal of the Community Services (Torres Strait) Act 1984. The Mer (Murray) Island Magistrates Court officially opened on 31 January 2008.
