Under the "Liquor Act 1912", all licensing districts formerly constituted under repealed Acts became licensing districts for the constitution of licensing courts replacing licensing authorities. The constitution of a licensing court within the licensing district of Atherton was gazetted on 1 May 1913.
Licensing courts were responsible for granting, regulating and rescinding liquor licences within a licensing district. The granting of licences by the licensing court was annual and included licences for licensed victuallers' licences, wine sellers' licences, packet licences, billiard and bagatelle licences.

Under the "Liquor Acts Amendment Act 1935" the Licensing Courts were to be called Courts of Petty Sessions. The Licensing Commission, which was established under this Act, assumed responsibility for issuing licences while Courts of Petty Sessions retained responsibility for maintaining the registers of licences and records of charges and complaints.
