Following the enactment of the "Industrial Arbitration Act of 1916", the Industrial Magistrates Court, Brisbane was created on 12 January 1917. Police Magistrates were appointed on 30 January 1917 to preside over the newly created court.

Industrial Magistrates hear cases which involve industrial disputes such as failure to pay wages, breaches of industrial agreements, workers compensation and other industrial issues.

Under the "Justices Amendment Act of 1964", Stipendiary Magistrates and Clerks of the Court were empowered to act as Industrial Magistrates. Under the "Industrial Magistrates Act 1999", an Industrial Magistrates Court is constituted by a magistrate sitting alone.

Appeals from decisions taken by Industrial Magistrates were dealt with by the Industrial Court of Queensland which was the only industrial tribunal in Queensland until the "Industrial Conciliation and Arbitration Act" was enacted in May 1961, and the Industrial Conciliation and Arbitration Commission was created with powers to carry out most of the arbitral functions of the Industrial Court, as previously constituted. Under the "Industrial Magistrates Act 1999", the Industrial Court of Queensland remains largely judicial in character, dealing with appeals from decisions of, among others, Industrial Magistrates.
